1. Validity of sales conditions
1.1. The terms and conditions of sale apply to the purchase of goods and services between the buyer from the www.aiamajad.com online store and the company Tene Kaubandus OÜ.
1.2. In addition to these terms and conditions, legal relationships arising from the purchase of products from the Tene Kaubandus OÜ online store are governed by the Law of Obligations Act (hereinafter VÕS), the Consumer Protection Act (hereinafter TKS) and other legislation in force in the Republic of Estonia.
1.3. Tene Kaubandus OÜ reserves the right to make changes to the sales conditions. The mentioned changes will be reflected on the website www.aiamajad.com
1.4. The images of the products in the online store are for illustrative purposes and may differ from the actual products.
1.5. There may be unintentional errors in the description of the products in the online store.
1.6. Tene Kaubandus OÜ has the right to withdraw from the sales contract concluded through the e-shop without sanctions and to not deliver the ordered goods or not provide the service in the following cases:
– the goods are out of stock;
– the price or characteristics of the goods have been displayed incorrectly in the e-shop due to a system error;
If Tene Kaubandus OÜ is unable to fulfill the order, Tene Kaubandus OÜ will contact the buyer and return the amount paid in advance.
2. Prices
2.1. All prices in the Tene online store include VAT 22%.
2.2. The prices on the website do not include the cost of transport to the customer.
2.3. The prices are valid from the time the order is placed until the payment deadline for the placed order expires (1 day after the order is placed).
3. Forming the order
3.1. Add the desired product to the shopping cart.
3.2. To see the contents of the shopping cart, select “Shopping cart” from the top right corner of the web page.
3.3. Fill in the required data fields with your data.
3.4 To confirm your order, tick the box “yes, I agree to the terms” and then select “Next”.
3.5. After completing the order, you will receive an Order confirmation in your e-mail, after which our customer service representative will contact you separately to specify the necessary purchase details.
3.6. Orders placed in the Tene aiamajad online store are handled on working days from 9:00 a.m. to 5:00 p.m. If the order is placed on Friday after 2:00 p.m., the order will be processed on the following Monday.
4. Entry into force of the sales contract
4.1. With the contract of sale of goods, Tene Kaubandus OÜ undertakes to hand over to the buyer the existing goods, manufactured or to be acquired by Tene Kaubandus OÜ in the future and to enable the transfer of ownership to the buyer, while the buyer undertakes to pay Tene Kaubandus OÜ the amount shown on the invoice for the goods and to accept the goods.
4.2. Orders that have not been paid for will be canceled 7 days after the order was placed.
4.3. The sales contract comes into effect after the payment made by the buyer has been received in the bank account of Tene Kaubandus OÜ.
5. Delivery
5.1 All goods are located at Lihula mnt. 22b, 90510 Haapsalu
6. Right of return
6.1. After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop without giving a reason within 14 days. The 14-day right of return applies only to private consumers. The 14-day right of withdrawal does not apply to legal entities.
6.2. It is possible to familiarize yourself with the goods and make sure of their suitability or non-suitability, examining the goods means using them in the same way as in a retail store before buying.
6.3. The returned product must be complete (include the product packaging and all items included in the product packaging). If the product was purchased as part of a campaign, where another product is added to the product, you must return the entire set (i.e. all products).
6.4. In the case of deterioration of the goods to be returned, the buyer is responsible for the decrease in value due to the use of the item, to make sure of the nature, characteristics and functioning of the item, the buyer should handle and use the item only as he would be allowed to do it normally in the store.
6.5. In order to return the goods, you must submit a free form withdrawal from the purchase of the goods and send it to the address info@tene.ee within 14 days of receiving the goods at the latest.
6.6. The buyer must return the goods within 14 days after submitting the application or provide proof that he has handed over the goods to the logistics company within the aforementioned period.
6.7. Tene Kaubandus OÜ will return all fees received from the buyer based on the contract to the buyer immediately, but no later than 14 days after receiving the withdrawal statement.
6.8. All costs of directly withdrawing from the goods are borne by the buyer.
7. Force majeure
7.1. Tene Kaubandus OÜ is not responsible for damages caused to the Customer or delays in the delivery of the goods in the event that the damage or delay in the delivery of the goods is due to circumstances that Tene Kaubandus OÜ could not influence or foresee.
8. Processing of personal data
8.1. By entering data in the online store and with the corresponding confirmation, the buyer gives the right to collect and process the buyer’s personal data (name, contact phone number, package delivery and/or home address, e-mail address) and to forward personal data to logistics partners for the delivery of goods.
8.2. Tene Kaubandus OÃœ has the right to use the buyer’s contact data to transmit advertising and other information to the buyer.
8.3. The buyer has the right to prohibit the collection and use of his personal data at any time, unless it is necessary to collect a claim arising from the contract or to deliver the goods.
8.4. Encrypted data communication with banks when paying for purchases ensures the security of the buyer’s personal bank credentials, and they are also inaccessible in the online store.
9. Warranty and claims submission procedure
9.1. Tene Kaubandus OÜ is responsible for the non-compliance of the goods sold to the buyer with the contract conditions or defects that appear within two years from the handing over of the goods to the buyer.
9.2. The buyer has the right to contact Tene Kaubandus OÃœ within two months at the latest in the event of a defect, presenting the invoice on the basis of which the purchase of the goods was paid for. Notification of non-conformity of goods must be sent to Tene Kaubandus OÃœ’s e-mail address info@tene.ee. In the event that the buyer does not inform about the non-conformity of the goods within the term specified in this clause, Tene Kaubandus OÃœ is released from responsibility for the non-conformity of the goods.
9.3. If the goods show defects, please stop using the goods.
9.4. Tene Kaubandus OÜ is responsible for the non-conformity of the goods and defects that appear within 2 years from the handing over of the goods to the user as follows:
– within the first six months from the moment of handing over the goods, it is assumed that the non-conformity of the goods already existed at the time of the handing over of the goods, i.e. the obligation to prove the conformity of the goods to the quality rests with Tene Kaubandus OÃœ-ll.
– after six months have passed from the moment of handing over the goods, the obligation to prove non-compliance with the quality of the goods rests with the buyer.
9.5. Tene Kaubandus OÜ and the buyer agree on the repair or replacement of defective goods.
9.6. Tene Kaubandus OÜ is not responsible for defects in the goods due to the fault of the buyer, which have arisen as a result of improper storage or use of the goods,
9.7. In the event of non-compliance or defects in the goods, please send a complaint to the e-mail address info@tene.ee, where the name of the person who placed the order, contact telephone number, order number and a precise description of the non-compliance or defect in the goods are indicated.
9.8. A claim regarding the non-conformity of the goods or the discovery of defects must be submitted within two months from the discovery of the non-conformity of the goods.
9.9. All claims will be reviewed and the buyer will be contacted as soon as possible, but no later than within 14 days of receipt of the claim.
9.10. The buyer has the right to demand that Tene Kaubandus OÜ reduce the purchase price or terminate the contract and demand a refund for the goods if Tene Kaubandus OÜ is unable to repair or replace the goods, or the repair or replacement of the goods fails.
10. Buyer’s right to appeal to the Consumer Complaints Commission
10.1. If Tene Kaubandus OÃœ has refused to resolve the buyer’s complaint or the buyer does not agree with the solution offered by Tene Kaubandus OÃœ and considers that his rights have been violated or his interests have been damaged, the buyer may submit a complaint to the Consumer Complaints Commission through the Consumer Protection Board. The buyer can file a complaint himself or through a representative. The information of the Consumer Protection Commission is provided on the website of the Consumer Protection Board, to solve problems arising in the member states of the European Union, contact the European Union Consumer Advisory Center.
